Terms of Service

1. Acceptance of Terms

By accessing or using the Cardiac Rhythm Simulator website, applications, content, and related services (collectively, the “Service”) operated by ShadeTree.IT LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Educational Use Only

The Service is provided exclusively for educational and informational purposes. The Service does not provide medical advice, diagnosis, treatment, or clinical decision support. Use of the Service does not create any physician-patient, clinician-patient, instructor-student, fiduciary, or other professional relationship.

4. No Emergency Use

The Service must not be used in an emergency or urgent clinical setting. If you believe you or another person may be experiencing a medical emergency, contact local emergency services and a qualified healthcare provider immediately.

5. Use at Your Own Risk

YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. The Service is provided on a best-effort basis and may contain errors, omissions, broken links, outdated materials, or unavailable features. We do not warrant that the Service or any output from it is complete, accurate, reliable, clinically valid, or fit for any particular purpose.

6. AI-Assisted Content Disclosure

Portions of the Service, including educational explanations, summaries, examples, and supporting materials, may be generated or assisted by artificial intelligence systems. AI-assisted content may be wrong, incomplete, misleading, or outdated. Any internal review we perform is intended to improve readability, not to certify medical correctness or clinical safety. You are responsible for independently verifying all information against authoritative medical sources before relying on it.

7. Simulator and Data Disclaimer

The Service may include synthetic rhythms, curated educational examples, and real-world ECG materials from third-party sources. Synthetic rhythms are educational approximations only and may differ from real clinical presentations in morphology, timing, amplitude, or other characteristics. Third-party data and source materials remain subject to their original terms, licenses, and limitations. See our Data Sources page for provenance and attribution details.

8. User Accounts

Certain features of the Service require an account. You are responsible for maintaining the confidentiality of your account credentials, for activities that occur under your account, and for providing accurate and current information. We may suspend or terminate access if we reasonably believe your account is being used unlawfully, abusively, or in violation of these Terms.

9. Intellectual Property and Third-Party Materials

The Service, including our original software, layout, branding, and original text, is owned by ShadeTree.IT LLC or its licensors and is protected by applicable intellectual property laws. Some images, datasets, quotations, and other materials available through the Service are provided under Creative Commons licenses or other third-party permissions and remain the property of their respective owners. You may not remove attributions, misrepresent authorship, or reuse third-party materials except as permitted by their applicable license terms.

10. User Content

You retain ownership of content you create and store through the Service, such as saved rhythms. You grant us a non-exclusive, limited license to host, store, back up, display, and process that content solely as needed to operate and improve the Service. You are solely responsible for ensuring that your content does not violate law, infringe third-party rights, or contain malicious code.

11. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code or engage in activities that could harm the Service or other users
  • Use the Service to provide or support real medical diagnoses, treatment decisions, or emergency care
  • Remove, obscure, or alter copyright notices, license notices, or required attributions

The Service may link to or rely on third-party services, websites, datasets, login providers, and infrastructure. We do not control and are not responsible for third-party content, availability, accuracy, policies, or security. Your use of third-party services is governed by their own terms and policies.

We use Microsoft Clarity to see how visitors use the Service, so that we can improve it. By using the Service, you agree that we and Microsoft may collect and use this data. Our Privacy Policy describes what is collected and how it is used.

13. Fees, Support Payments, and Cancellation

We may choose to offer paid features, subscriptions, one-time purchases, voluntary support payments, or other paid access to parts of the Service. Unless expressly stated otherwise in writing at the time of purchase, all amounts paid to us are final and non-refundable, including after partial use, account closure, suspension, content removal, or your decision to stop using the Service. You remain responsible for all charges incurred before termination. If you believe a charge was made without your authorization, contact us promptly. Nothing in this section limits any non-waivable refund rights that apply under law.

Monthly support renews automatically. If you choose monthly support, you are agreeing to a recurring charge. We charge the amount you selected on the day you start, and again on the same day each month, using the payment method you provided. The charge repeats automatically until you cancel it. The amount, the monthly frequency, and the automatic renewal are shown to you before you complete your purchase, and our payment processor, Stripe, sends you a receipt for every charge. We may change the amounts we offer to new supporters; we will not change the amount of your existing monthly support without telling you in advance.

How to cancel. You may cancel your monthly support at any time, without contacting us, using the link on our support page and on the Manage your support page. Cancellation takes effect at the end of the billing period you have already paid for. You are not charged again after that, and we do not prorate or refund any part of the period in which you cancel. You may also change your monthly amount using the same link; a change takes effect at your next monthly charge and is not prorated.

Support is not a charitable contribution. The Service is operated by ShadeTree.IT LLC, a for-profit company. Amounts you pay us as support are voluntary payments to a for-profit company that help us operate and improve the Service. They are not charitable contributions and they are not tax-deductible. We do not issue charitable-contribution receipts, and nothing on the Service is tax advice.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. SHADETREE.IT LLC MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHADETREE.IT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHADETREE.IT LLC’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF ZERO U.S. DOLLARS (US $0) OR THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

16. Indemnification

You agree to indemnify and hold harmless ShadeTree.IT LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

17. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any legal action arising out of these Terms shall be brought in the courts of the State of Illinois.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms on this page and update the “Last updated” date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
